$18,600,000 Recovery for Negligent Equipment Maintenance

The Krist Law Firm recently made a significant recovery of $18,600,000 on behalf of a client who suffered severe ankle and foot fractures. Our client was involved in a construction project when the equipment he was utilizing failed and dropped him to the ground. Through a multi-year forensic investigation and through corporate depositions, we were able to reveal the neglect and malfeasance that led to this failure. The Defendant in the case offered only $100,000 to resolve the case in pre-trial mediation, which was rejected. The trial began, and the Defendant re-evaluated their exposure and ultimately settled the case for $18,600,000.

$15,120,000 Recovery For Lineman Struck By Steel Cable

A 19-year-old man working as a lineman for a Houston mooring company was struck in the head with a steel cable while he, among other crew members, attempted to attach a 600-foot tanker to the Houston dock. Upon placing tension on the somewhat deteriorated cable, it ricocheted and hit the man with significant force. Scott C. Krist represented the man, who was now looking to sue the company for negligence under general maritime law.

Our client suffered a traumatic brain injury resulting in cognitive deficiencies that will forever impact his memory and concentration skills. He also sustained permanent weakness in both his left arm and leg and will be unable to continue working.

With his medical bills growing to nearly $300,000, our personal injury attorneys were driven to find justice for the man. Working tirelessly, they alleged that the company failed to properly inspect the steel cables prior to use. As trial approached, an agreement was reached and our client saw a successful recovery of $15,120,000. Expenses for this case totaled $370,767.36 with an attorney fee of 40%. This recovery was the second-largest published maritime personal injury recovery in Texas history at that time.

Verdict of $6,028,000 Awarded After Motorcycle And Tractor Trailer Collision Results In Below-The-Knee Amputation

A 30-year-old man was driving his motorcycle south on Highway 16 in Harris County with his 9-year-old daughter when they were involved in a horrible collision with a tractor trailer. The father and daughter were traveling in the left lane of a two-lane highway, attempting to pass the tractor trailer who was driving in the right lane. Without properly looking before switching lanes, the tractor trailer struck our clients as he moved over to the left lane.

It was at this time the father contacted Houston truck accident lawyer Scott C. Krist for legal support in this unfortunate circumstance.

The father and daughter were both immediately taken from the scene by ambulance and underwent thorough emergency room care. The man, an electrical operator, suffered a serious crush injury to his right foot which quickly became septic. His young daughter sustained a mid-shaft fracture to her right femur and underwent surgical intervention that resulted in a scar on her leg. Two weeks after the incident, the man underwent a below the knee amputation. Our client was later fitted for a prosthesis, which would require replacement every four years.

Under the legal guidance of experienced Houston truck accident injury attorneys Scott Krist and Alex W. Horton, our client proceeded to sue the tractor trailer company and driver for both vicarious liability and motor vehicle negligence based on these life-changing injuries. Attorneys Horton and Krist fought on behalf of their clients. During an intense five-day trial, both attorneys responded with an aggressive argument including the tractor-trailer presented no warning that he was turning, due to a loose pigtail connector on the trailer turn signal. Furthermore, Horton and Krist strongly argued that the driver failed to inspect this problem prior to taking off, holding him 100% accountable for the accident.

We successfully obtained a jury verdict with total damages in the amount of $6,028,000.00. Our client received an amount of $5,057,302.82 after pre-judgement interest and reductions for contributory negligence. The case was then settled for $5,000,000.00. Case expenses totaled $124,917.92 with an attorney fee of 40%. Both the father and daughter can continue to put this accident behind them with a successful outcome. This was the largest verdict involving a commercial truck accident in Texas in 2014.

Head-On Collision Causes Memory Loss, Other Injuries, $4,750,000 Recovery

Scott C. Krist recently helped a woman who suffered from multiple fractures to both her femurs, her foot and pelvis, a lacerated spleen and liver, a permanent traumatic brain injury, and a TMJ injury after being involved in a serious head-on collision with a professional tree servicing company truck.

Both drivers, enduring the disastrous force, had no memory of the accident or what happened moments leading up to it. Unfortunately, there were no witnesses around when the auto accident occurred. The only evidence to go off of were the skid marks on the road, to determine who was at fault for this traumatic collision.

After analyzing the impact from the road markings, it was later determined that this major truck accident in Houston occurred in our client’s lane, therefore proving the truck driver had caused the incident. With that, our client saw a recovery of $4,750,000. Case expenses totaled $42,166.26 with an attorney fee of 40%.

$4,000,000 Recovery In Houston Premise Liability Case

A Houston resident was walking down a flight of stairs in his apartment complex when he suddenly tripped and fell over the railing, plummeting seven feet. The fall paralyzed the man who immediately relied on Scott C. Krist to help him with a Houston premise liability case against the apartment complex.

Our attorneys sympathized with the man, now facing a life-changing and uncertain future. A further investigation into the case revealed a metal stairway stringer about a quarter of an inch above the floor, no railing on one side and only one working light in the stairwell. All factors, our client said, the landlords were previously aware of, yet failed to take into consideration and repair. With a strong argument, we successfully recovered $4,000,000 for our client. Case expenses totaled $79,697.43 with an attorney fee of 40%. This was the largest premises liability recovery in Texas in 2013.
