It is not illegal in Texas to drive while wearing headphones.

However, according to Texas law, it is illegal to drive recklessly.

It’s important to remember that the lack of a law specifically prohibiting driving with headphones does not automatically make it legal.  However, it does mean that the legality of driving while wearing headphones falls under a broader umbrella of reckless or distracted driving.

For example, if a law enforcement officer believes a driver’s use of headphones behind the wheel poses a risk, they can issue a citation for distracted driving.

Listening to music, phone conversations, audiobooks, or podcasts can distract a driver’s attention from the road and surrounding motorists and pedestrians. The National Highway Traffic Safety Administration (NHTSA) reports that in a recent year, distracted driving caused the deaths of 3,522 people and caused injuries to an additional 362,415 people, leading to an economic cost of $98 billion from distracted driving accidents.

Driving with headphones reduces situational awareness and causes a cognitive distraction, meaning it takes your mind off the road and driving.

Wearing headphones can impair a driver’s ability to communicate with other motorists through verbal and non-verbal warnings and other auditory cues. If a driver is distracted by what they are listening to through headphones, they may miss important cues, such as hand gestures, or safety indicators, such as hazard lights. Failing to slow down or move to another lane can lead to an accident.

Disorientation

If a driver is wearing headphones when an emergency situation arises, they may become disoriented or startled, causing them to respond to the emergency inappropriately or dangerously.

For example, they may stop suddenly rather than safely merging into a lane out of the emergency vehicle’s path. Further, if disoriented, the driver may not have time to appropriately investigate where the sirens or horns are coming from and what to safely do next.

How Driving with Headphones Can Impact Car Accident Claims

Liability and fault play a major role in car accident lawsuits. If a driver wearing headphones is involved in an accident, it can impact the insurance adjuster’s assessment of liability. Both the insurance company and your attorney will scrutinize the driver’s actions leading up to the collision.

If the driver’s use of headphones is deemed to be a contributing factor to the crash, it will likely be used against them when determining fault. The argument can be made that the driver’s reduced awareness due to their use of headphones was negligent.
